Please read all terms and conditions carefully before making any booking through this site.
Ozcruising is a licensed travel agent and member of the Travel Compensation Fund.
Ozcruising ACT License Number 18800618. TCF License Number 9541. Words defined
in Legal Notices and Disclaimers have the same meaning in these terms.
Legal Contract
When making a payment, by way of the numerous payment methods we offer, and
therefore confirming your booking with Ozcruising, you agree to be bound by the
legal obligations outlined throughout these Terms and Conditions. Your right to
any refunds can be limited by our terms and policies and by the conditions of
the particular supplier.
NB: All minimum deposits received are non refundable and non
transferable.
Please ensure you understand and agree to all our terms and policies before
confirming your booking with us. Once payment is made for the booking, it is
deemed that you have read and understood the terms and conditions for the
booking. If you have any queries, please contact us before making any booking
for any service.
This Contract is governed by the laws of the Australian Capital Territory. You
agree that any action you bring against us will be heard in the Australian
Capital Territory.
Agency
Products and services are sold by Ozcruising as an agent for wholesale companies
and other suppliers providing services, including accommodation and
transportation services. Ozcruising is not a provider of these services and has
no responsibility for the services provided or not provided by any party. We
give and make no warranty or representation regarding the standard of any
service or product to be supplied and no person has authority to make any such
representation or warranty on behalf of Ozcruising. All tickets, coupons,
exchange orders, vouchers and receipts are issued subject to the appropriate
tariffs, terms and conditions of sale of the suppliers and these terms. They are
issued by us as an agent only. We have no responsibility, and extend no
guarantees for discontinued promotions, cruises or specific holiday products.
Liability
Ozcruising has no liability for any act, omission or default, whether negligent
or otherwise, of cruise lines, airlines, car rental operators, ferry companies,
hoteliers, tour operators or any other supplier. We have no liability for any
loss or damage occasioned by the negligence, act or omission of any supplier or
other third party. We reserve the right to cancel or modify itineraries or
bookings where circumstances require.
In circumstances where liability of Ozcruising cannot be excluded, such liability
is limited to the value of the purchased travel arrangements. Ozcruising
reserves the right to decline any booking for any individual on any tour or
other service.
Illustrations
Photographs and illustrations and other promotional material displayed on our
website are for promotion purposes only. Itineraries, routes, weather
conditions, ship cabin configurations, ship décor and so forth can change
without notice.
Availability
The services sold through Ozcruising are subject to availability. Advertised
fares are for new bookings only and can be withdrawn without notice. Access to
this site and any site normally linked to this site is not guaranteed and is
subject to availability.
Partial Cruises
Occasionally, cruise lines may allow you to do a portion of a cruise if
availability allows. However Ozcruising only advertise complete cruising
itineraries as well as advertised sectors for lengthy cruises. If you require a
partial cruise and availability is available, you will need to book it directly
with the cruise line.

Cancellations
All deposits paid are non refundable and non transferable.
Once the Ozcruising final balance due date has been reached, a 10% cancellation
of the total cruise fare will apply.*
*Please note this is in addition to the cruise lines cancellation fees as per
their terms and conditions.
Passenger Details
When making a booking for two to four passengers, the first passenger in your
booking will be the main contact for all correspondence. Please ensure when
making your booking, and if you are the preferred person to be contacted, you
are passenger one in the booking and your contact details are supplied. If other
individuals travelling on your booking require different particulars, you will
need to contact us. At the time you are ready to confirm your booking, by way of
payment, please check that your details are correct and have not changed before
making a payment. If you are making a booking for person/s other than yourself
it is your responsibility to ensure that each individual person is made aware of
these terms and conditions.. terms and conditions.
Passenger Name
It is essential that you enter details of each passenger correctly and according
to passport or other identification. Some suppliers will deny carriage if the
passenger’s name varies from your booking and may cancel automatically if the
passenger’s name is amended. Ozcruising has no responsibility for any loss or
damage arising from incorrect entry of passenger’s names any inability to travel
as a result of carrier's policies.
You may be able to change a passenger in a booking, providing that one original
passenger remains in the booking and that you are more than 7 days from sailing.
Fees do apply for a name change. Please see terms and conditions for current
fees and charges.
Unlicensed Entity Disclaimer
If you request Ozcruising to arrange for the provision of products or services by
a person or company which is not licensed in accordance with any applicable law,
Ozcruising accepts no liability (whether in contract, for negligence or
otherwise) for any loss or damage suffered by you or any third party as a
result.
Special Conditions for Products
The terms displayed on this website apply generally to all the products and
packages sold by Ozcruising. Some products also have special conditions applying
to them. Airlines, hotels, wholesalers and other suppliers have various other
terms and conditions relating to the purchase of these goods and services. Some
of those terms will be displayed in the rules applicable to a particular
product, others not at all. For example, suppliers often limit or exclude
liability in respect of death, personal injury, delay and loss or damage to
baggage, however we do not have those conditions to display. It is your
responsibility to check those terms and conditions before making a booking
through Ozcruising.
Cruise Bookings...Special Conditions
There are numerous rules and regulations affecting most advance purchase and
other discounted cruise fares, which involve substantial cancellation or
amendment fees, and in some instances there are no refunds whatsoever on
cancelled holidays should you need to amend or cancel your travel plans. If you
have any queries regarding these fees please do not hesitate to contact our
office. You must read the rules and check the conditions applicable to every
cruise and ensure that you accept those rules and conditions before you make a
booking. If the rules and conditions are not displayed you should contact our
office. Once you confirm a booking and make payment you are bound by the rules
and conditions applicable to the relevant supplier.
Alterations to Tour Itineraries by Suppliers
In the event of material alterations by a supplier to a proposed cruise booked by
you, you may be given the option of cancelling the cruise without penalty but
this is not always guaranteed. The right to cancel is subject to the conditions
of the supplier. Your acceptance of any tickets, coupons, exchange orders,
vouchers and receipts will be deemed acceptance of the above conditions and of
any alterations made to your tour.
Travel Documents
It is very important that you read the following information carefully and
contact us if you require any assistance in any area.
Passport
All individuals departing from Australia and visiting any foreign port must be in
possession of a valid passport. If your passport is due to expire within six
months of your return arrival back in Australia then under normal circumstances
you should obtain a new passport. Should you be travelling on anything other
than an Australian Passport then it is your responsibility to bring this to our
attention as you may require a visa or permit to re-enter Australia. Names on
the travel documents must match exactly the names as written on the passport
which will be taken from the booking form.
Visa Requirements
Certain countries require a Visa for entry prior to arrival. Please ensure you
are fully informed of the requirements before you make a reservation as visas
can take some time to obtain.
Vaccinations are strongly recommended for certain destinations. Please contact
your local doctor who will advise you of these requirements. Please note that
vaccinations may be recommended some period in advance of travelling.
Travel Insurance
We strongly recommend that all clients take out travel comprehensive insurance
when making a booking. We recommend that insurance covers loss of deposit and
other monies through cancellation, loss or damage to personal baggage and loss
of money, medical expenses, additional expenses to cover hotel accommodation and
repatriation costs to Australia should any services need to be extended or
curtailed due to illness or other insurable risk. Please note that restrictions
on the time to effect insurance apply to some services such as airfares. Please
contact us to arrange travel insurance before making payment for a service.
Rates and Price Variations
We reserve the right to vary published rates in the event of changes in exchange
rates or price rises made by wholesalers or other suppliers. If the cost of any
service increases due to exchange rate fluctuations, price increases, tax
changes or any other reason, you must pay the increase when notified. We are not
liable in any way if any increase occurs. Rates quoted are per cruise, as
appropriate to the particular product.
Currency
All rates and prices quoted are quoted in Australian dollars and as such are
valid only in Australia. We regret that we cannot accept online bookings from
customers located outside Australia at this time.
Price Inclusions and Exclusions
Items included in the prices or rates of the products are specified in each
section. Prices do not include, unless stated, government departure taxes,
passport and visa charges, vaccination fees, port charges, airport taxes, any
items of a personal nature such as telephone calls, beverages, laundry, excess
baggage charges and gratuities, travel insurance or other items not specified.
Goods and Services Tax
Prices quoted do include goods and services tax or similar tax ("GST"). GST is
payable by you in respect of any supply made to you. You must pay the amount of
GST payable in the respect of the supply. GST is payable at the same time and in
the same manner as the price or at such later time as Ozcruising may request. If
